Terms of Use and Privacy Policy

The Terms of Use and Privacy Policy is an agreement ("Agreement" or "Terms of Use and Privacy Policy") between the Federal Home Loan Bank of San Francisco (the "Bank" or "us") and the user of this site (referred to as "you" here). If you are accessing this site on behalf of one of our Members, then "you" also refers to that Member, "Member" also means you, and this Agreement also binds that Member.

If you are a Member, then by clicking the boxes that state "I agree to the Terms and Conditions" and "Submit," you are agreeing to the terms of the Agreement. If you are a public user, then your use of this site is your consent to this Agreement.

We reserve the right to change the Agreement at any time. If we do change it, you will have to review and accept the revised Agreement upon the next login to access this site if you are a Member. If you are a public user, then you must review this Agreement each time you use the site.

An important function of this Agreement is to alert you that the data presented on this site is not warranted or otherwise guaranteed. Please read this carefully.

Authorized Access

  1. This site is divided into a Members only area and a public area. Both areas are subject to this Agreement, and no one may enter or use any area of the site without first agreeing to these Terms of Use and Privacy Policy. The Members area of this site can only be properly accessed through the Member Login at member.fhlbsf.com, where Members’ authorized users enter username and password.
  2. Some areas of the site contain data specific to a Member, and these pages may only be accessed by those specific Members and their authorized users, subject to the terms of this Agreement. No other person may access those areas or the information displayed there.
  3. Persons duly authorized by the Bank may access any page or data on this site, including those specific to a Member, and such persons are bound by written confidentiality agreements to keep non-public information confidential.
  4. Access to any portion of this site in excess of the authority provided here is a violation of federal criminal law and also gives rises to civil liability.
  5. If you are a Member, your user name, password, and your SecurID tokens will be disabled after six months of non-use.

No False Information

You shall not provide any false information in connection with the use of this site. Also, you agree to update or correct any information that you have provided if the information becomes outdated or misleading. You must use the site consistent with all applicable laws and regulations.

Disclaimers

The information on this site comes from a variety of sources and includes information that is subject to change without notice. The Bank seeks to keep this information up-to-date and accurate, but we cannot guarantee and do not warrant that the information is accurate, complete, or current. Some of the information displayed on these pages changes rapidly, sometimes every day, and sometimes from minute to minute. The accuracy and timeliness of the data is subject to delays in connectivity across the Internet, your systems, and other facilities outside the control of the Bank. Therefore, you must independently verify the accuracy of any information presented here.

However, you may make copies of our data and information on the site solely for use in connection with a Member’s business. Some data on our site is updated on a real time basis and is proprietary or is licensed to us by third parties. You will not copy, reproduce, alter, modify, create derivative works, or publicly display any content (except for data you provide) from our site without our prior express written permission, or that of the appropriate third party.

Limitation on Liability

In no event will the Bank or any other party involved in creating, producing, or distributing this site be liable to you or any third person for any direct, indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits arising from your use of (or inability to use) the site even if we have been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, the Bank’s liability to you or any Member for any cause whatsoever, and regardless of the form of the action, will at all times be limited in the aggregate to $100.00.

This limitation on damages includes but is not limited to damages that result from reliance by you on any information obtained from this site, or from mistakes, omissions, interruptions, deletion of files or e-mail, errors, defects, viruses, delays in operation or transmission, or any failure of performance (whether or not resulting from acts of God), communications failure, theft, destruction, or unauthorized access to the Bank’s records, programs, or services. This paragraph applies to all content and services and software available through this site. Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states (if their law is deemed to apply) liability is limited to the fullest extent permitted by law.

Governing Law and Jurisdiction in San Francisco

All agreements on this site are governed by and shall be construed in accordance with the laws of the United States and, to the extent applicable, the State of California. The user and Members agree that any action arising from any matter relating directly or indirectly to this site shall be brought in the courts of the State of California or the federal courts sitting in the City and County of San Francisco, State of California, that those courts have personal jurisdiction over you and the Member for that purpose, and you waive any right to bring or seek transfer of any such action to any court outside of San Francisco.

For Members: No Security Transactions

No information presented on this site has any connection or relevance whatsoever to the sale or exchange of any security, other than the deposit or release of security to the Bank for safekeeping or the pledge or release of securities as collateral for Member advances.

None of the information at this site is part of any offering notice or offering circular for consolidated obligations of the Bank or other credit products of the Bank. Only Member institutions and certain eligible financial institutions may transact business with the Bank.

The material on this site is set forth for informational purposes only. You acknowledge that this material (i) does not represent financial, accounting or investment advice; (ii) does not constitute an offer to extend credit, a grant, or a subsidy; and (iii) does not constitute investment solicitation or an offer to buy or sell securities. For Members: Advance Transactions

Through access to the Members only area, member.fhlbsf.com, the Bank provides an alternate method for its Members to request certain types of advances from the Bank. The Bank establishes a "Financing Availability" for each Member, setting the total dollar amount, maximum maturity, and other terms for all credit products and other Member obligations available without additional credit underwriting or review by the Bank. A Member’s Financing Availability is based on the Bank’s assessment of the Member’s creditworthiness and financial condition as reported to the Member’s regulator and the results of periodic regulatory examinations, financial reports, and other relevant information. A Member’s Financing Availability is subject to review and change by the Bank at any time. If your institution requires credit in excess of its approved Financing Availability, you may submit a written request, which will be reviewed by the Bank.

The Bank’s ability to extend credit under a Member’s established Financing Availability is conditioned on the Member’s compliance with the Bank’s Advances and Security Agreement (and other applicable agreements, including the Bank’s Credit Program), specific eligibility or documentation requirements and policies applicable to specific Bank products), credit considerations, the borrowing capacity of collateral pledged by the Member, other eligibility requirements established by the Bank, and regulatory limits on extensions of credit to the Member.

The Bank is under no obligation to execute a requested advance for any reason, including without limit, market conditions, changes in posted interest rates, aggregate daily funding limits, and other factors that may affect the Bank’s ability to execute the requested advance, as determined by the Bank in its sole discretion.

A Member should discuss with its accountants, attorneys, investment advisors and other financial representatives and consultants whether and to what extent any of the Bank’s credit products are appropriate and useful to it and its business.

For Members: Other Agreements

The terms and conditions related to the Bank's products and services are governed by various agreements between the Bank and its Members, as well as Bank policies and applicable laws and regulations. In the event of express inconsistencies between this site material and the agreements, policies, laws and regulations related to such agreements, the agreements, policies, laws and regulations shall be determinative.

Privacy Policy

This Privacy Policy only relates to the information we collect online from this site. It does not apply to information we may receive through the mail, by fax or telephone, or in person or in any other way. The Bank is committed to protecting the privacy of its Members’ customers by maintaining the confidentiality of non-public personal information (as that term is defined in the Gramm-Leach Bliley Act of 1999 and the various implementing federal regulations).

The effective date of this policy is August 1, 2004. If you are a Member, we will inform you of changes to this Policy by asking you to review it if we change it. If you are a public user, you must review this Agreement each time you use the site. You can ask us to change the data about you that we keep by communicating with us at webmaster@fhlbsf.com. Unless otherwise noted, we keep data indefinitely.

Use of Cookies

We collect and store information about your visit to our site. To collect some of this information, our web server places a "cookie," which is a small file, on your hard drive. Accepting the cookies used by our site does not give us access to your personal information. We may use cookies to enhance your online experience, to facilitate your use of our site, and to collect anonymous, aggregated site-visitation statistics that we can use to measure the effectiveness of and improve the site and to improve our products and services. Cookies allow us to refine site usage reports to identify (on an anonymous basis) the number of first-time visitors and return visitors to our site. This information helps us monitor our site and determine that it is accessible. The cookie that allows us to identify return visits is persistent (it remains on your computer between visits); but it does not contain personal information. Other cookies used by this site are transient and are erased after you complete your internet session. You cannot access the site at all if you disable cookies on your browser.

Additional Information Collected

  • We collect site usage information such as your I.P. address, the address of the internet site you were visiting before you entered our site, the browser and operating system you are using, pages visited, and time spent on a page, and other similar information. This is used to produce site usage reports. For public users, the information is anonymous, that is, it is not attributed to any identifiable person. It is possible to correlate this data with specific users who log in on behalf of Members.
  • We retain your username and encrypt your password when you log into the Members’ area.
  • We use return e-mail addresses to answer the e-mail we receive. If applicable, we also use e-mail addresses, name, title, organization and type, address phone and fax numbers to communicate with you about your online registrations and subscriptions. This information is not shared with any other parties except as stated below.
  • Usage logs and reports may be analyzed and reviewed by third parties who have written confidentiality obligations. These are not sold to third parties.
  • If you submit an application or form to us online, or request an online transaction, the Bank may store the information you send in an electronic database.
  • For the purposes of updating our mailing list information, we collect data on individuals such as name, title, institution, institution address, phone, fax, and e-mail address. We retain that information until you provide new information.
  • For the purpose of registering for events, we may ask for all of the information above, plus a credit card number. When you submit credit card information, you are in fact directed to one of our contractors, VeriSign, and all your credit card related data is provided directly to that contractor, and not to the Bank. This data is transmitted via a secure link.
  • For the purpose of subscribing to our newsletter, we require information such as name, institution, address, city, state, zip, phone and fax. We also request, but do not require, the subscriber’s title, e-mail address and industry type. The information is retained until you provide new information or until we determine that the information is no longer correct.
  • From time to time, we may ask users of our site to respond to online surveys. We may ask for the user’s name, title institution name, and/or institution type. Information from these surveys is aggregated and retained to report on perceptions of types of users of the site.

Information Security, Use and Storage

All communications sent to, or from, the site after Member Log In and in the Members’ areas occur over a secure socket layer (SSL) encryption designed to protect such communications. We do not store the data in an encrypted format.

There are some things that you can do to help protect the security of your information as well. Never give out your password, since this is what is used to access all of your account information. Remember to log off from our site and close your browser window when you finish surfing the web, so that other people using the same computer won't have access to your information.

You must immediately inform us by contacting Web Support at (415) 616-2610 if you have any reason to believe that your password has been stolen or used, or is in the possession of an unauthorized individual or is otherwise compromised.

It is not our policy to share information we receive from you over the site other than with regulators or certain companies that assist the Bank in conducting its business transactions. Certain non-personal information collected pursuant to survey requests may be aggregated and shared with Members of the Bank. Certain employees of the Bank have access to Member information to enable them to respond to Member inquiries and concerns. All Bank employees are subject to the terms of a confidentiality agreement. Any vendors or consultants who have access to confidential information are required by contract to keep the information confidential.

This site contains links to other websites. We are not responsible for the privacy practices or content of other websites. When you leave our site, please read the privacy statements of each website that collects personally identifiable information. This privacy statement applies solely to information collected by this site.
